3. Products and Services

3.1 Product Information

We strive to display our collectibles and products as accurately as possible. However, we do not warrant that product descriptions, images, or other content on the Site is accurate, complete, reliable, current, or error-free.

3.2 Pricing

All prices are listed in USD and are subject to change without notice. We reserve the right to modify or discontinue products without notice. Prices do not include applicable taxes, which will be added at checkout based on your shipping address.

3.3 Availability

All products are subject to availability. We reserve the right to limit quantities of any products or services we offer. We may discontinue any product at any time.

4. Orders and Payment

4.1 Order Acceptance

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. We will notify you if we cancel all or part of your order.

4.2 Payment

We accept payment through Stripe and support major credit cards. By submitting your order, you authorize us to charge the payment method provided. All payments must be received in full before shipment.

4.3 Sales Tax

Applicable sales tax will be calculated and added at checkout based on your shipping address. Currently, we collect sales tax for orders shipped to California.

5. Shipping and Delivery

5.1 Shipping Restrictions

We currently ship only within the United States. International shipping is not available at this time.

5.2 Shipping Times

Shipping and delivery times are estimates only and not guaranteed. We are not responsible for delays caused by shipping carriers or circumstances beyond our control.

5.3 Risk of Loss

All items purchased from Pando Market are shipped pursuant to a shipment contract. Risk of loss and title for items pass to you upon delivery to the carrier.

6. Returns and Refunds

6.1 Return Policy

We offer a 30-day return window from the delivery date. Items must be returned in original condition, unused, and in original packaging.

6.2 Non-Returnable Items

The following items cannot be returned:

  • Items marked as "Final Sale"
  • Any trading card products – All trading card purchases are final
  • Items damaged by the customer
  • Items returned after the 30-day window

6.3 Return Process

To initiate a return:

  1. Contact us at [email protected] with your order number
  2. We will provide a return authorization and shipping instructions
  3. Ship the item back using a trackable shipping method
  4. Once received and inspected, your refund will be processed

6.4 Return Shipping

For defective or incorrect items, we will provide a prepaid return label. For change of mind returns, the customer is responsible for return shipping costs.

6.5 Refunds

Approved refunds will be processed to the original payment method within 5-10 business days after we receive the returned item.

7. Intellectual Property

All content on this Site, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Pando Market or its content suppliers and is protected by United States and international copyright laws.

9. Disclaimer of Warranties

THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED BY PANDO MARKET ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. PANDO MARKET MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS, OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE, UNLESS OTHERWISE SPECIFIED IN WRITING.

IN NO EVENT SHALL PANDO MARKET, OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SITE OR SERVICES.

You agree to submit to the personal jurisdiction of the federal and state courts located in California for any actions not subject to arbitration.

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the Streamlined Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS").

13.2 Class Action Waiver

You agree that any arbitration or legal action shall be limited to the dispute between us and you individually. You waive the right to participate in a class action or class-wide arbitration.

We reserve the right to update or change our Terms at any time. Your continued use of the Site after we post any modifications to the Terms constitutes your acceptance of those modifications.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
